Waiver / Permission to enter US territory

The Waiver is a process through which one can obtain permission to enter US territory despite a potential ban due, for example, to the presence of a criminal record.

An analysis of admissibility is conducted on a case-by-case basis and is relative to several factors, including the nature, gravity, and context surrounding the offenses. The time elapsed since the offenses and the applicant’s general rehabilitation status are also factors taken into account.

It is recommended that an individual has at the very least finished serving their entire sentence (fine, probation, community service, etc.) before submitting an application.

Why apply for a Waiver of Inadmissibility to the United States?

The waiver of inadmissibility to the United States (hereinafter the “Waiver”) allows individuals to travel to the United States without concern, despite having one or more criminal records. A simple layover in the U.S. territory, in the presence of a criminal record, can lead to a denial of entry. However, certain offenses, such as impaired driving, are not sufficient to warrant an inadmissibility determination.

Do not wait until you are caught in the act and face deportation proceedings before applying for one.

Impact of the pardon on admissibility at the American border

The application for suspension of a Canadian criminal record, commonly called the "pardon," does not allow passage across the American border. Indeed, although the Canadian pardon demonstrates significant rehabilitation and will be an asset for the Waiver application, the American government does not recognize any official status for it on its territory.

FAQ

How long is it valid for?

The Waiver can be valid for 1 to 5 years depending on the case.

A U.S. Entry Waiver (officially Form I-192) is a waiver of inadmissibility that allows you to travel to the United States with peace of mind, despite having one or more criminal records.

You need it when traveling to the USA or if you have a layover in the United States and have one or more criminal records. However, if you only have a record for impaired driving (DUI), customs officials generally do not consider this type of charge as grounds for inadmissibility.

The entire process can take between 9 and 12 months, depending on the applicant’s specific situation. The full timeline and steps will be explained to you during your initial consultation.

The fee is $950 for a TURNKEY service for new applications, and $550 for renewals. Additionally, U.S. Customs and Border Protection charges a fee of $1,100 USD to process and analyze your application.
