ACCESS IDentity and Investigation Inc (hereinafter “ACCÈS”) is concerned about protecting your privacy and the personal information it collects on its Web site or any other technological means, uses or communicates to third parties in the course of its activities.

This Privacy and Confidentiality Policy sets out how ACCES protects the personal information it holds, in order to take into account the requirements of applicable privacy laws to which it is subject, as well as any other applicable privacy laws and regulations.

ACCES is responsible for protecting the personal information it holds or entrusts to a third party, as the case may be. In fact, it must comply with the rigorous procedures of these four organizations to maintain its operating permits: the Royal Canadian Mounted Police, the Cobourg Police Department, Equifax Canada and the Quebec Private Security Bureau.

ACCES ensures that not only its employees, but also third parties with whom it does business, protect the confidentiality of personal information to which they have access, regardless of the nature of the medium or the form in which it is accessible.

2. Personal information we collect

The types of personal information that may be collected from time to time by ACCES may include the following information:

  • Name,
  • First name,
  • Address,
  • Phone number,
  • Email address,
  • Financial information concerning a payment or billing,
  • Any other personal information you provide to us when you fill out one of our survey forms, such as your driver’s license number and banking information.,
  • Any information about you obtained by a third party in the course of an investigation, such as your employment history, credit record or criminal record.

Personal information is collected online when users complete and submit a request for a police certificate or an appointment or contact via forms on the website to request our services and when an individual is being investigated on behalf of a third-party client organization.

3. Reason for collection

We use personal information in the course of providing our services, where we carry out various investigations and verifications. The information collected and used in this context is subject to specific consent (as described more fully in the Consent section).

We also use Personal Information to communicate with you and to protect against error and fraud, track transactions and comply with legislative and governmental requirements.

We collect, use and/or disclose Your Personal Information for the following purposes:

The Personal Information you provide to ACCESS may be transferred to third-party service providers who provide services on Our behalf. These services may include billing, marketing, information technology, hosting and data processing services.

As part of a business transaction, in connection with the proposed or actual financing, securitization, insuring, sale, assignment or other disposition in whole or in part of ACCESS or its business or assets, for the purposes of evaluating and/or executing the proposed transaction. We may transfer personal information that we collect or that you provide as described in the Policy to service providers and other third parties that we use to support our business. These third parties are contractually obliged to keep personal information confidential, to use it only for the purposes for which we disclose it and to treat personal information according to the standards set out in the Policy and in compliance with the Laws.

Your personal information is processed and stored in Quebec. In the event that a transfer of personal information outside Quebec is necessary in the performance of ACCESS’s duties, such transfer will only take place if it is assessed that the information would benefit from adequate protection, notably by considering the sensitivity of the information, the purpose for which it is to be used, the safeguards the information would benefit from, and the legal regime applicable in the state or province where the information would be disclosed. The transfer will also be subject to appropriate contractual agreements to ensure adequate protection.

ACCES does not sell information to third parties.

6. Consent - collection, use and communication

ACCESS IDentity and Investigation Inc. obtains your consent before collecting, using or communicating your personal information to third parties, except in the cases provided for by law.

ACCESS IDentity and Investigation Inc. will not use or disclose personal information without your consent, unless authorized or required to do so by applicable law.

In some cases, ACCESS may collect personal information about an individual without his or her consent, in accordance with the Acts or any other law or regulation permitting such collection.

We will only collect, use or disclose your Personal Information with your knowledge and consent, unless we are permitted or required to do so by law. Consent may be given in various ways, depending on the type of Personal Information collected, used or disclosed:

  • When conducting surveys, ACCESS will obtain Your express consent (verbal, written or electronic) to collect, use or disclose sensitive Personal Information, such as Personal Information of a financial nature;
  • ACCESS will use Your implied consent to collect, use or disclose Your Personal Information where: (i) express consent has already been given; or (ii) the purpose of the use of the Personal Information is reasonably apparent to You.

ACCESS will ensure that Your consent is only required to the extent necessary for the Services, activities and programs offered.

7. Data retention period

Unless authorized or required by applicable laws or regulations, we will retain your personal information only as long as necessary to fulfill the purposes for which it was collected, including satisfying legal, accounting or notification requirements of appropriate governmental and regulatory bodies. In certain circumstances, we may anonymize your personal information so that it can no longer be associated with you. We reserve the right to use such anonymized and de-identified data for legitimate purposes, without further notice or consent from you.

We protect your personal information by security measures (physical, technical or administrative) appropriate to the nature of the information, in order to prevent unauthorized access, use or disclosure to third parties, or in order to prevent loss or other breaches of security.

If we are unable to provide you with access to your Personal Information, we will inform you of the reasons, subject to any legal or regulatory restrictions. Such restrictions may include, for example, the involvement of information about another person that would reveal their personal information or confidential commercial information, or information that is difficult and prohibitively expensive to obtain.

In order to enable us to provide our Services, ACCES, or one of its third-party service providers, may collect, use, communicate, store or process personal information on servers located in jurisdictions other than your residence, for the purposes described in this Policy. Please note that privacy laws in these jurisdictions may differ from Canadian and Quebec privacy laws. The reasonable measures, contractual or otherwise, that we may take to protect your personal information while it is being processed or handled by these service providers are subject to applicable foreign legal requirements, including lawful requirements to disclose personal information to government and law enforcement authorities in certain circumstances. 11. Use of the website

This policy applies to information we collect, use or disclose about members of the public and users of the site.

The ACCESS Web site uses cookies. A cookie is a small text file saved on the hard drive of the user’s computer. This file is completely harmless and cannot contain viruses. There are three distinct uses of cookies on the site:

  • In order to prevent misuse of the information entered on the website and/or online request forms, the cookie file, which can only be read by the site’s software, makes it possible to recognize the user’s computer and thus impose a limited number of daily online form submissions. The presence of a cookie file enables the site to check the identity of the user’s computer only when he or she uses this application.
  • To analyze visits to its site, ACCESS uses Google Analytics software, which uses cookies to record certain visitor behaviors, such as the number of visits to the site, the path taken and the duration of the visit. Under no circumstances do cookies allow us to identify individual visitors.
  • In the context of advertising campaigns, ACCESS uses Facebook technologies (Meta) that employ a unique browser and user identifier used for targeted advertising and campaign tracking. If combined with an identifier already held by Facebook, this unique identifier may contain personal information, which will be handled in accordance with Facebook’s privacy policy.

The data remains completely anonymous and is used solely to improve the ACCESS site according to the needs of its visitors.

The Site may include links to third-party websites, plug-ins, services, social networks or applications. Clicking on these links or activating these connections may allow the third party to collect or share information about you. If you follow a link to a third-party site or use a third-party plug-in, please note that these third parties have their own privacy policies and we take no responsibility for these policies. We do not control these third-party sites and encourage you to read the privacy policy of each site you visit.

Through your use of the site, you agree to the terms and conditions of the policy. Any changes to this policy will be posted on this page.

12. Data security

The security of your personal information is very important to us. We have implemented appropriate and reasonable physical, organizational, contractual and technological security measures to protect your personal information against loss or theft, as well as unauthorized access, disclosure, copying, use or modification. We have taken steps to ensure that only those members of our staff who absolutely must have access to your personal information in the course of their duties are authorized to access it.

Persons working for or on behalf of ACCESS must :

  • – Make reasonable efforts to minimize the risk of unintentional disclosure of personal information;
  • – Take special precautions to ensure that personal information is not monitored, overheard, accessed or lost when working in premises other than ACCESS offices;
  • – Take reasonable steps to protect personal information as it moves from place to place.

Also note that the way ACCESS communicates with you may be influenced by circumstances and by the people whose personal information or confidentiality is at stake.

Subcontractors with access to personal information in the custody or control of ACCESS will be made aware of this Privacy Policy and other applicable policies and processes to ensure the security and protection of personal information. All subcontractors will be required to agree to comply with the policies and processes and the Laws prior to commencing their work for ACCESS.

Despite these measures, no transmission or storage method is 100% secure or error-free. Unfortunately, we cannot guarantee absolute security. If you have reason to believe that your interaction with us is no longer secure (e.g. if you are concerned that your account credentials may have been compromised), please contact us immediately using the details provided below. If we become aware of a security breach affecting your personal information, we will inform you and the relevant authorities as soon as possible, in accordance with the Laws.

13. Contact details and commitment to compliance

We have procedures in place to receive and respond to complaints or inquiries regarding our handling of personal information, our compliance with this policy and applicable privacy laws.

If you are not satisfied with how ACCESS has handled your personal information, you may file a complaint with ACCESS. The complaint will be investigated by ACCESS’ Privacy Officer, who will determine whether the handling of personal information complies with ACCESS’ policies, protocols and practices and any other applicable laws. The Privacy Officer will make every reasonable effort to resolve complaints. The person filing the complaint will be informed of any progress or outcome of the investigation within a maximum of 30 days of receipt of the request and/or any additional time required to complete the investigation.
